"More than a month after the Environmental Protection Agency placed San Antonio in its “non-attainment” category because of persistently high levels of smog-producing ozone, Texas Attorney General Ken Paxton on Tuesday asked a federal court to overturn the federal designation.

San Antonio’s status came after a change in 2015 that tightened rules regarding harmful ozone. The designation could be costly for the city’s economy by delaying transportation and manufacturing projects, the San Antonio Express-News previously reported.

The ruling could be harmful to the economy and has “minimal, if any, public health benefit,” according to a press release from Paxton. The state’s petition was filed for review in the U.S. Court of Appeals for the Fifth Circuit."
