"Appeals Court Clears Way for Start Of EPA's Cross-State Rule" [1]

"Federal appellate judges greenlighted yesterday U.S. EPA's implementation of a program to curb air pollution that drifts between states.

The order from the U.S. Court of Appeals for the District of Columbia Circuit comes after the Supreme Court upheld many aspects of the program in April, reversing a decision by the D.C. Circuit (Greenwire, April 29).

In December 2011, the D.C. Circuit had placed the agency's Cross-State Air Pollution Rule (CSAPR) on hold. One of EPA's most complex regulatory regimes, the program applies to 28 Eastern states and requires states to cut emissions that cause their neighbors to exceed federal pollution standards."
