"EPA: Judge Rejects Suit To Release Calendars But Urges Change"

"A federal judge is suggesting that EPA provide speedier public access to the agency chief's calendar, even if the type of access requested is not compelled by the Freedom of Information Act.

In an intriguing decision that both affirms EPA's FOIA stance and also gives officials a nudge, U.S. District Judge John Bates ruled yesterday the agency did not have to publish on a rolling basis the administrator's detailed daily calendar.

But while concluding that "FOIA does not require EPA to publish" the calendar entries being sought, the judge appointed by President George W. Bush all but recommended voluntary action."
