"Appeals Court Judges Question Mercury Exemptions in EPA Rule"

"A panel of three appellate judges grilled attorneys for the Environmental Protection Agency and the Natural Resources Defense Council in a suit about the exemptions to the agency’s mercury inventory reporting rule.

The judges heard oral arguments Nov. 20 in the U.S. Court of Appeals for the Second Circuit over a challenge to the June 2018 rule from the NRDC and Vermont. The two contend the EPA’s mercury reporting rule (RIN:2070-AK22) unlawfully exempted too many manufacturers and importers to effectively protect human health and the environment.

The lawsuit was also backed by a coalition of 11 other states that have their own mercury restrictions and are members of the Interstate Mercury Education and Reduction Clearinghouse (IMERC)."
